The website, www.stephaniepeacock.com (the “Site”) is owned and operated by Stephanie Peacock. (“we” or “us”). By using this site and all links within the site, you signify your assent to these Terms and Conditions, our Privacy Policy, our Refund Policy, all applicable laws and regulations, and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from the Us. If you do not agree to all of these Terms and Conditions, do not use this site. Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service. Stephanie Peacock (“SP”) may revise and update these Terms and Conditions at any time. Your continued usage of the SP website/portal (“SP Site,” or the “Site,”) will mean you accept those changes. This Site Does Not Provide Medical Advice.
The contents of the SP Site, such as text, graphics, images, and other materials created by SP or obtained from SP’s licensors, and other materials contained on the SP Site (collectively, “Content”) are for informational purposes only. The content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Content and other features are subject to change or termination without notice in the editorial discretion of SP. All rights not expressly granted herein are reserved to SP and its licensors. If you violate any of these Terms and Conditions, your permission to use the Content automatically terminates and you must immediately destroy any copies you have made of any portion of the Content.

You acknowledge that WE have the right but not the obligation to use and display any postings or contributions of any kind and that WE may elect to cease the use and display of any such materials (or any portion thereof), at any time for any reason whatsoever.

Liability of SP and Its Licensors

Passwords
SP has several tools that allow you to record and store information. You are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to your SP passwords or accounts. It is your sole responsibility to: (1) control the dissemination and use of sign-in name, screen name and passwords; (2) authorize, monitor, and control access to and use of your SP account and password; (3) promptly inform SP if you believe your account or password has been compromised or if there is any other reason you need to deactivate a password. To send us an email, use the “Contact Us” links located at the bottom of every page of our site. You grant SP and all other persons or entities involved in the operation of the Site the right to transmit, monitor, retrieve, store, and use your information in connection with the operation of the Site. SP cannot and does not assume any responsibility or liability for any information you submit, or your or third parties’ use or misuse of information transmitted or received using SP tools and services.
To use certain features of the Site, you will need a username and password, which you will receive through the Site’s registration process via Practice Better. You are responsible for maintaining the confidentiality of the password and account, and are responsible for all activities (whether by you or by others) that occur under your password or account. You agree to notify us immediately of any unauthorized use of your password or account or any other breach of security, and to ensure that you exit from your account at the end of each session. We cannot and will not be liable for any loss or damage arising from your failure to protect your password or account information.
User Content Guidelines
If you use, or post User Content on, a Public Area, such as message boards, blogs, or post on any Social Media Platform, you are solely responsible for your own communications, the consequences of posting those communications, and your reliance on any communications found in the Public Areas or on the Social Media Platforms. SP and its licensors are not responsible for the consequences of any communications in the Public Areas or on Social Media Platforms. In cases where you feel threatened or believe someone else is in danger, you should contact your local law enforcement agency immediately. If you think you may have a medical emergency, call your doctor or 911 immediately.
In consideration of being allowed to use the Public Areas and Social Media Platforms, you agree that the following actions shall constitute a material breach of these Terms and Conditions:
1. Using a Public Area or Social Media Platform for any purpose in violation of local, state, national, or international laws;
2. Posting material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others;
3. Posting material that is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity as determined by SP in its sole discretion;
4. Posting advertisements or solicitations of business;
5. After receiving a warning, continuing to disrupt the normal flow of dialogue, or posting comments that are not related to the topic being discussed (unless it is clear the discussion is free-form);
6. Posting chain letters or pyramid schemes;
7. Impersonating another person;
8. Distributing viruses or other harmful computer code;
9. Harvesting, scraping or otherwise collecting information about others, including email addresses, without their identification for posting or viewing comments;
10. Allowing any other person or entity to use your identification for posting or viewing comments
11. Posting the same note more than once or “spamming”; or
12. Engaging in any other conduct that restricts or inhibits any other person from using or enjoying the Public Area, Social Media Platform or the Site, or which, in the judgment of SP, exposes SP or any of its customers or suppliers to any liability or detriment of any type.
Refund Policy
Your satisfaction with your Program, Product or Service is important to us. Yet, because of the extensive time, effort, preparation and care that goes into creating and/or providing our Subscriptions, Programs, Products, Services and Program/Subscription Materials, we have a no refund policy. Unless otherwise provided by law, you acknowledge that we do not offer refunds for any portion of your payment for any of our Programs, Products, and Services, and no refunds will be provided to you at any time.
By using and/or purchasing any of our Programs, Products, Services or Program Materials, you understand and agree that all sales are final and no refunds will be provided.

From time-to-time, we may recommend, promote or introduce you to products, services and/or offers made by third-parties. In the spirit of full transparency, we may derive commissions from such sales or offers.

WE may host message boards, chats and other private/public forums on its Sites and on other platforms. Any user failing to comply with the terms and conditions of this Agreement may be expelled from and refused continued access to, the message boards, groups, chats or other such forums in the future. US or its designated agents may remove or alter any user-created content at any time for any reason. Message boards, chats and other public forums are intended to serve as discussion centers for users and subscribers. Termination
We may cancel or terminate your right to use the Site or any part of the Site at any time without notice. In the event of cancellation or termination, you are no longer authorized to access the part of the Site affected by such cancellation or termination. The restrictions imposed on you with respect to material downloaded from the Site, and the disclaimers and limitations of liabilities set forth in these Terms of Service, shall survive.
Subscription Billing Terms
If you are signed up for any subscription or recurring payments through Stephanie Peacock. please abide by the billing terms and agreements for said service that you agreed upon when signing up. It is up to the member (you) to cancel this subscription in accordance with the terms and conditions.
Telecoaching/Telemedicine
You may purchase your Telecoaching session online, and schedule it upon purchase.
Cancellation of Telecoaching
If you need to cancel or reschedule your appointment, please contact Stephanie Peacock via portal, text, email, or phone www.stephaniepeacock.com. You must reschedule/cancel your appointment at least 1 business day before your consultation, otherwise you forfeit the money you have paid or the cost of the visit. Please be aware that holidays and weekends do NOT constitute business days. Late fees can be collected using the credit card on file at the end of the business day in which the appointment was supposed to occur.
Please be sure you receive a confirmation of the cancellation or rescheduling. If you do not reschedule your consultation within the cancellation period, your consultation will be forfeited.

Notices:
Except as explicitly stated otherwise, any notices shall be given by certified postal mail, return receipt requested, to Married to Health, 4533 MacArthur Boulevard #5228, Newport Beach, CA 92660. Notice shall be deemed given three (3) days after the date of mailing.
Dispute Resolution:
These Terms of Use shall be governed by and construed in accordance with the laws of the State of California and any dispute shall be subject to binding arbitration in Dana Point, California. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
Class Action Waiver
You may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations aren’t allowed.
The arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a class or representative proceeding or claims (such as a class action, consolidated action or private attorney general action) unless all relevant parties specifically agree to do so following initiation of the arbitration.
Severability
If any clause within this Provision (other than the Class Action Waiver clause above) is found to be illegal or unenforceable, that clause will be severed from this Provision, and the remainder of this Provision will be given full force and effect. If the Class Action Waiver clause is found to be illegal or unenforceable, this entire Provision will be unenforceable and the dispute will be decided by a court.
Miscellaneous
These Terms of Service, together with the Privacy Policy, contain the entire agreement of the parties, and supersedes any and all oral negotiations and/or representations of the parties hereto made in relation to this transaction. This agreement neither confers nor creates any rights or responsibilities not specifically enumerated herein.
Any waiver or forbearance by the US of any breach by you of any provision of this Agreement shall not be construed as a waiver of any subsequent breach by you.
This Agreement shall be binding upon and inure to the benefit of US and our respective assigns, successors, heirs, and legal representatives. Neither this Agreement nor any rights hereunder may be assigned without the prior written consent of US Notwithstanding the foregoing, all rights and obligations under this Agreement may be freely assigned by US to any affiliated entity or any of its wholly owned subsidiaries.
